TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL BBOP Center Service and Products, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.
SECTION 17 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless BBOP Center Service and Products, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). By accessing or using our website, entering or using our building and facilities, or purchasing our services, you agree to be bound by these Terms. BBOP Center reserves the right to modify these Terms at any time, and such modifications will be effective immediately upon posting to the website or upon notice at the BBOP Center Building.
2. DESCRIPTION OF SERVICES AND FACILITIES
BBOP Center provides business development services, entrepreneurship training, workshops, facility rentals, and related programs supporting entrepreneurs in the Inland Empire region. The BBOP Center Building serves as our physical location for in-person services, workshops, meetings, and facility rentals. Our website serves as an informational resource and e-commerce platform for purchasing services, registering for programs, and reserving facility rentals through our Shopify-integrated checkout system.
3. ONLINE PURCHASES AND SHOPIFY CHECKOUT
All purchases made through the BBOP Center Website are processed through Shopify, a third-party e-commerce platform. By making a purchase, you agree to the following:
Payment Processing: All payment transactions are securely processed through Shopify Payments or other payment providers integrated with our Shopify store. BBOP Center does not directly store your credit card or payment information.
Pricing: All prices displayed on our website are in U.S. dollars unless otherwise indicated. BBOP Center reserves the right to change prices at any time without prior notice.
Order Confirmation: Upon completing a purchase, you will receive an order confirmation email. This confirmation does not constitute acceptance of your order for rental services (see Section 4 below).
Taxes: Applicable sales taxes will be calculated and added at checkout in accordance with California state and local tax requirements.
4. BBOP CENTER BUILDING FACILITY RENTAL RESERVATIONS AND APPROVAL
IMPORTANT NOTICE REGARDING RENTAL PURCHASES: Any rental purchase or facility reservation for the BBOP Center Building made through the BBOP Center Website or Shopify checkout is subject to final approval by BBOP Senior Management due to availability and conflicting use requirements.
Completion of an online rental purchase or reservation request does not guarantee approval or availability of the requested facility, date, or time at the BBOP Center Building. BBOP Center operates multiple programs and serves various stakeholders, which may result in scheduling conflicts or facility unavailability.
Approval Process: Following your online rental purchase, BBOP Senior Management will review your request within three (3) to five (5) business days. You will receive written confirmation via email regarding the approval or denial of your rental request.
Denial and Refunds: If your rental request is denied due to availability conflicts, scheduling issues, or other operational requirements, BBOP Center will issue a full refund of your rental payment within seven (7) to ten (10) business days.
Conditional Approval: BBOP Senior Management may approve rental requests with conditions, including but not limited to modified dates, times, or facility spaces within the BBOP Center Building. You will have the option to accept the modified terms or request a full refund.
5. BBOP CENTER BUILDING USE AND CONDUCT
When visiting, using, or renting space at the BBOP Center Building, you agree to:
Comply with all posted rules, regulations, and instructions from BBOP Center staff; Treat all facilities, equipment, and furnishings with care and respect; Not engage in any illegal, disruptive, or dangerous activities on the premises; Not bring prohibited items including weapons, illegal substances, or hazardous materials onto the property; Vacate the premises at the conclusion of your scheduled time or upon request by BBOP Center staff; Report any damage, safety concerns, or maintenance issues to BBOP Center staff immediately.
BBOP Center reserves the right to refuse entry, terminate facility use, or remove any individual from the BBOP Center Building who violates these Terms or engages in conduct deemed inappropriate, unsafe, or disruptive by BBOP Center staff or management.
6. REFUND AND CANCELLATION POLICY
Workshop and Program Registration: Cancellations made at least seven (7) days prior to the scheduled event are eligible for a full refund. Cancellations made less than seven (7) days prior may be subject to a cancellation fee or offered as credit toward future programs.
BBOP Center Building Facility Rentals: Approved rental reservations may be cancelled with a full refund if notice is provided at least fourteen (14) days prior to the rental date. Cancellations made less than fourteen (14) days prior may forfeit up to fifty percent (50%) of the rental fee.
Services and Consulting: Refunds for consulting and business development services will be handled on a case-by-case basis and are subject to the terms outlined in any applicable service agreement.
7. USER CONDUCT AND RESPONSIBILITIES
When using the BBOP Center Website and services, you agree to:
Provide accurate, current, and complete information when making purchases or registrations; Use our website and services only for lawful purposes and in accordance with these Terms; Not engage in any activity that interferes with or disrupts our website or services; Not attempt to gain unauthorized access to any portion of our website, systems, or networks; Not use our services for any fraudulent or illegal purpose.
BBOP Center reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion if we believe you have violated these Terms.
8. INTELLECTUAL PROPERTY
All content on the BBOP Center Website and materials provided at the BBOP Center Building, including but not limited to text, graphics, logos, images, course materials, and software, is the property of BBOP Center or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. 9. PRIVACY AND DATA PROTECTION

THE BBOP CENTER WEBSITE, BBOP CENTER BUILDING, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
